Default Paternity Action & Damages/Awards
This is rather far out - but I live in FLORIDA and have a crazy ex who is threatening to file a paternity suit because he believes I am pregnant with his child - but it is absolute frivilousness because I hadn't been with him for ages before I got pregnant. I know it is not his child, but the only way to prove it is for him to do this paternity suit. Once the DNA test confirms that he is NOT the father, can I counter-sue him for all this grief? Or, could I request attorneys' fees or damages??? Is there anything at all I can get from this A-hole??? Thanks.

States typically require that a moving party in a paternity case identify the approximate date of conception. If it's wildly wrong - 14 months before the child is born - the judge may well view the case as frivolous. If not, even if you argue that he is fabricating your last sexual liaison, it's a swearing contest the court will likely not care to resolve. Don't count on recovering legal fees or having a valid lawsuit against him.
