Drinking and Driving on Private Property

Is it illegal to drink and drive on your own private property in the state of Ca or any other state???

Many state laws, probably most, no longer make a distinction between drunk driving on public property or drunk driving on private property, and criminalize both.

A friend has a quad acident on private property envoling another person ( 2nd rider, same quad ). Second party on quad is not pressing charges. Ambulance is called to the scence for help and with the Ambulance comes the county law. The county prosecutor is charging said friend with a drinking and driving offense. What legal basis is appleid to justify such a charge?
