[COLOR="Red"]me and my babys fatther got into a incident about 3 days ago he came to drop off the baby and we got into a arguement because his chain was missing and he said it was in my house i told him if i found it i would return it mind u we have previous domestic violence issues i ask him to leave he said not until he found what he was looking for he got madd and saw my chain on my table and took it i asked him to give it back i approaced himto get it and he push me and grabbed me by my neck and left out my house with it. i called the police and pressed charges and now he is in jail for a felony robbery but before he got locked up he returned my chain since i got it back i donot wanna press the charges i have been subponeaed to court to testify but if i want the charges dropped should i go? would i get in any trouble if i did not go? would they just dissmiss the case?[/COLOR]
It's no longer up to you. The prosecutor can proceed with charges. It's not possible for us to know from what you wrote if the prosecutor will be able to present sufficient evidence to secure a conviction without your appearing as a witness.
couldnt you and his attorney file an affidavit of non prosecution.go to trial.and then beat it like that...if the DA picks up the charges,who will testify against him,i mean it worked for me in a Domestic violence case..
