Default Terminating Rights of Non-Biological Father - Norfolk Virginia
I have been the step-parent of a seven-year old girl for 3 years now. Her father who is not her biological father but is on her birth certificate has been paying child support for approximately the same amount of time. He has however made little attempt to call or visit her (3 times in 3 years). In trying to get back at my wife for having him removed from her residence 6 years ago, he is trying to re-enter the daughters life by taking us to court to draw up strict visitation rules (now that he's freeloading off another woman and has married her and moved into HER house and using her money). He has full physical custody and joint legal custody of his ACTUAL biological daughter from a previous marriage but sent her back to his mother when he was discharged from my current wife's home as indicated earlier. He also had a son whom he raised from that previous marriage, who, after giving him his name and professing to love him, when the boy was 7 he took him to have a DNA test done and found he wasn't the bio. After raising him for seven years and paying child support for the boy after divorce from his mother, the court just kicked the poor little boy to the curb, said child support was no longer required and was sent back to his mother (how do you call that in the childs best interests). My wife and I are trying to prevent the same thing from happening to our little girl. We are already seeking a lawyer on this but while we wait, wanted to get the forums take on this situation. The visitation paperwork has not been drawn up yet. If we petition for paternity (this is in Norfolk, VA), court finds out he's not the bio, and I want to adopt the young girl right then and there, is there a chance based on the fact that he's not even taking care of his actual BIO daughter now that he could have his parental rights stripped relating to my 7 year old step-daughter???

If you think he would like to be removed from the birth certificate, see if you can get his consent to, for example, step-parent adoption.
