unfortunately I am a parent who has to deal with a son who made a completely idiotic decision and was caught by Sears stealing a $70 jacket. I've never been involved with anything like this so I am looking for any suggestions on how to try and minimize the far reaching consequences that I take could occur. I understand that Sears prosecutes for anything over $20 - which I guess means just about everything now. I also understand that there will be some type of civil action taken on their part to restitute cost of security, etc. Is anyone aware of how these things go down - i.e. for first time offenders what is 'normal' for this type of offense, how much is the civil fine usually, should I retain a lawyer for this kind of thing?
I spoke to the Store Manager and the LP person in Frisco who handled the situation. The LP person indicated that my son did not cause any problems and was very sympathetic but that they do prosecute (which I understand). Is there any benefit to my taking these actions and/or should I also approach the police and court to be proactive? I reside in Collin County, TX the event occurred in Frisco, TX (also in Collin County).
