    Question Being sued after arrangements already made

    I was given a chance to do a short payoff on a credit card that I owed on I signed documents in September 2006 for the payment arrangements on this credit card and I received a letter stating all was accepted and approved. The next thing I know I received a Civil Judgement complaint on this debt that was filed in October 2006, I have to respond with my answer within 28 days, first of all is this legal and 2nd of all what are my options? I live in the state of Ohio.

    You have a civil judgment? So you ignored a lawsuit and somehow managed to negotiate the payoff while the lawsuit was pending?

    No I was never in a lawsuit in regards to this credit card. I was offered a settlement and arrangements were made and then after I received the approval letter the judgement was filed I now have 28 days to answer the complaint. I was just wondering if this was even legal for them to do this. I have all the documentation on the settlement and also the acceptance letter.

    A judgment is filed at the end of a lawsuit, not the beginning. Are you sure it was a judgment that was filed?

    It says it is a Civil Complaint for judgement so maybe it is the beginning of the process for the judgement, but is it legal to be sued for something after arrangements have been made, as a matter of fact I just recieved my first bill for the first installment payment on this credit card. I don't want to pay for this twice. Once through my arrangements and then through wage garnishment.

    Try (a) contacting the lender and informing them that you are being sued despite the repayment agreement, and (b) contacting the law firm that is suing you and inform them that you are in a repayment agreement with the lender and are current in your payments.

    If this does go to court, show them the document of the agreement, and copies of the payments. If you are even 1 day late on the payment, the agreement is null and void, and they could sue you for the amount owed. This is my understanding, I am not a lawyer.
