Default New York State Paternity Help
I am in NYS...this is the story.

I am legally married w/2 kids and 1 on the way. My husband and I seperated a while back and I had a 1 night stand with a guy..now me and my husband are back together and working things out...but this guy is threatening a paternity test. I don't want to go through all of that and just wish he would leave us alone.

My question is...i am married, my husband will be on the birth certificate..can this guy really get a paternity test?? what right does he have?

Yes, of course he can! You can't just say, "Well, this never happened, and the potential father doesn't exist." How dare you!!

The law allows him to file a custody/visitation/child support action in court, and to force you to have a paternity/DNA test once the child is born.

If he is the father, then your "one night stand" just connected yourself to this guy forever!

thanks for posting your opinion. but i do have morals. I never cheated on my husband. when we seperated i actually thought it was for good, so what i did during that time had nothing to do with my marriage. Lots of married people seperate and reconcile. Its not like i ran out and had an affair, that would be different.

And the mother has every right to give the baby whatever last name she wanted. When I had my daughter 9 yrs ago the father wasn't around, I still thought she should know who he was and gave her his lastname. But he wasn't on the birth certificate because he wasn't there. At the time he wanted nothing to do with her, but he was young. Now he is being a responsible dad. But when I had her the hospital told me I could name her whatever i wanted. I could of given her Alex Rodriquez's last name if I wanted.
