    Question Separated wife pregnant with another man's baby

    My brother is in the Navy and stationed in Virginia. While he was deployed his wife went home to Florida and got pregnant in February. He got back in March. She stayed in Florida with her family and is now due mid November.

    For awhile he didn't know about the pregnancy and wanted her back so hadn't pushed fast for a divorce. Now he knows and they are still legally married. So I'm wondering is their any way he can be held legally and financially responsible for this child despite her acknowledging that it belongs to another man? Is there anything he can do now to protect himself?

    Also, I've read that every state is different, but what state laws does this fall under? They were married in Pennsylvania (where our family is from). His state of residence is VA now and that is where they last lived together. The baby will most likely be born in FL.

    He's still married to her, so the law will presume him to be the child's father. If he is now getting divorced, he should be sure to resolve the paternity issues as part of the divorce process. He would be wise to consult a lawyer.
