Default Wrongfully accused of battery
I was falsely accused of aggravated battery and criminal restraint. I broke up with my girlfriend ono night (12-26-03). She was drunk and ran down a gravel road at night and fell down. She scraped her face and bit through her lip then needing stitches. I guess that she told the police that I tackled her. That's what was in the report. I broke up with her because I found out that she was having sex with her brother-in-law for money. Many people, including her older sister, suspected them of having an affair. Only I found out for sure and she knows it. Fearing that I may expose the truth to her sister and every one else, she immediately began making up lies of all kinds getting me put in jail. And she has kept making false police reports against me ever since I broke up with her. She tells the police that I'm stalking her and calling her but I'm not. She got a PFA against me yet she continued calling me and stalking me. She gave me a death threat on the phone, which I recorded. She told me that I was going to be beaten and die before I ever prove it that she and her brother-in-law are having an affair. She also said that she wants her sister dead. Since she said that, I have been followed by her, her brother-in-law, and some other guy, sent by them, that blocked me in at a gas station and got out and threatened me and assaulted me in front of witnesses. I called 911 from my cell phone each time I caught her or her brother-in-law following me. Twice the police have pulled him over while he was following me. I am an appliance repairman. So, they had me "set up" on a phony service call. But, luckily, I caught on to it and didn't show up. Then someone called me back and threatened me. I recorded the setup and threat on tape. Her brother-in-law also called me and told me "Don't fall asleep." You see ... my cell phone has speaker on it. So, when they call me, I hold the phone up to a tape recorder and record everything. I have also had my cell phone company, Sprint, do phone traces each time proving the phone calls coming from them. Over the last year, that she had this PFA against me, she has probably called me at least a hundred times. I have recorded about 3 to 4 hours of her saying the craziest things. For example: she wants to come over and tie me up and jump my bones. She said that I would like it just enough to "get her off." She admits that she is stalking me. She also said that she knows that everything that I am going through is all her fault. She said that she just likes "****ing with me." I also have her on tape saying that she knows that I didn't knock her down but, that she fell down on that gravel road which caused her injuries. Thus, proving that I am innocent of the battery charge. Right? This, ... and there's so much more, all coming from a girl that is supposed to be so afraid and in fear of her life from me.
I have turned much of this evidence over to the Sedgwick Co. of Kansas detectives, the same police department that gave me my charges. They said that they showed it to the DA but, that they are not going to do anything about it.
After already serving 5 months in jail toward a 2 1/2 year sentence and fines and being placed on probation, I am totally broke and thousands in debt. Attorneys have told me that they may be able to help me but, not until I pay them. I have no money to pay them. I'm tired of being put in and out of jail when I am innocent. I'm tired of having to watch my back all the time. I'm tired of not being able to sleep at night. I am ashamed to admit this but, sometimes suicide seems like the only way out of this hell that she and the courts are putting me through. I've forgotten what it's like to feel free.
What can I do?

Unfortunately, without the help of an attorney, you're probably not going to get very far. If you don't want to hire a lawyer, consider moving to a different town (consistent with the terms of your probation).
