    Default How Long After a Problem Can You File for Contempt of Court

    My question involves a child custody case from the State of: Georgia

    Is there a time frame to file a contempt of court for a parent that is not complying with the custody order?

    If you're asking if your state has a requirement or specified time frame, no....but....if there are issues, then generally the sooner, the better. The longer you wait, the less likely the court is to feel that the violation is having a negative impact on the children, which is the court's PARAMOUNT concern. (In other words, if you allow some situation to continue for any significant period of time, the court is likely to believe that the parent bringing the contempt motion is doing so for reasons OTHER than it's impact on the children.)

    Without digging around for facts, if he has purged himself of the contempt the current petition should not be an issue (unless we're talking criminal contempt), beyond perhaps an attempt to recover the costs flowing to the other party from his contempt. If not, then the court will see that he continues to flout its orders.
