    Default Intestate Succession and Child Support

    In the state of PA....

    John and Jane Doe have a child together and John has adult issue from a previous marriage. They get divorced and John is paying Jane child support. If John Doe dies intestate, is Jane entitled to any of the estate for child support reasons, or is the estate simply split between John's issue? Assuming that Jane is not receiving alimony.

    While I hope you obtain a good grade on your assignment, I would, nonetheless, strongly suggest that you do your own homework and not depend upon anyone else for the answer to get that grade. Research and find the answer.

    LOL! This isn't for a test, I was just curious. I'm not looking for rock-solid legal advice, I'm just trying to get a general idea. Thanks!

    I thought it was a school assignment because no one, outside of law school or legal practice, uses the term "issue." That's a "term of art" in the practice of law.

    The estate is split among the children.
