    Default Guardianship over step daughter

    We live in Michigan. I have been sole supporter of daughter for 18 years. No child support. I recently lost my job but my new husband of one year has health care benefits. My daughter is now almost 19 and will be attending college. She lost my health care family benefits when I lost my job. For her to get health care benefits under his health care policy he must be named her guardian. Who has to sign off on this. Her ( as a legal, competent adult) her biological father who she sees infrequently and has never contributed to her support, or myself as her mother? If she was a minor this would not be an issue.

    You need to determine exactly the type of guardianship your husband's insurance will cover - court appointed or informal. Your daughter's father must be involved in the guardianship decision. Would he allow this?

    She's an adult. Although there are a variety of forms of guardianship in the state, Michigan seems to divide guardianships into two categories - guardians of minors, and guardians of legally incapacitated persons. I doubt that he can get a guardianship through the courts unless she is somehow disabled or incapacitated.

    Yes he would- can we do an informal without a lawyer?
