    Default Can an Inheritance be Taken Due to a Spouse's Back Child Support

    My question involves a marriage in the state of: TN. I married my husband to later find out that he owes an enormous amount of back child support. I have just been informed that I will be receiving an inheritance from my Dad's passing and I was wondering if the ex-wife has any right to that money for child support owed? We have a young child and theirs are grown. I know that she is entitled to the child support owed to her, but is my inheritance how she is going to be paid? Thank you!

    The correct legal answer is "as long as you keep your assets separate, Mom has no claim on your inheritance".

    However, morally? Just pay off his arrears. Gotta be better than a potential jail sentence, right?

    I am not sure that I agree with that advice...I don't think that I would use any inheritance I had to pay off the arrears of someone who omitted to tell me before we got married that they had child support arrears.

    Yeah, but I just can't imagine spending my relatives' hard earned money on my hub's bad judgment.

    Not disagreeing with that, at all

    Mind you, if I married someone who hadn't told me about something so huge - owing tons in back child support - that person might just find themselves not married pretty darn quickly, y'know?
