My 13 year old nephew was assaulted within his public school by another boy...school bully...who said "watch this" to another friend and proceeded to punch him in the stomach without provokation or warning....older boy has a history of "mischief" but no formal record to our knowledge...does this count as A&B or does his age preclude taking any action...victim's parents basically want the older boy to cease and desist but would proceed legally if necessary/adviseable...any advice?..."boys will be boys" and all but they would like to prevent this from continuing to happen all year. Thanks for advice and input.

If they're all thirteen then it would normally be a juvenile court matter if it came to the attention of legal authorities. Apparently so far it's being handled within the school? Is the school's response inadequate? What would the victim's parents hope to accomplish with legal actions?
