Child does not go to school

My 14 year old son lives with his father that has full custody of him, he did live with me until he was in the 3rd grade but was very hard to handle (not his fault he was told all kinds of things) his going to his fathers was ordered by a judge.

The problem is, he has not been to school for 3 years, they did buy home schooling books that I have tried to work with him on, but his dad will not make him sit and do the work he wants to put everything on me, so he does not have to mess with it. I pay his doctor bills, buy his clothes and shoes and yet his father drills it in his head that I am the bad one.

He lets him do whatever he wants with no rules, he stays with his girlfriend which is an accident waiting to happen. His dad says he is old enough to take care of himself.

I did talk to the school about enrolling him back but, I can not do that only his dad. I talked with a caseworker and was told it is my responsibility to take his father to court and get custody back.and they could not check on his school because if they go there all his dad has to say is he is home schooled.

I tried to make her understand that I cannot control him, for instance he was here last night and I told him to do something, he got mad and threw the phone at his sister and told me not to f***ing talk to him, then proceded to punch his sister.

There have been other times that he beat my younger son up and I could not get him off of him, he has raised his hand to me but his dad see's nothing wrong with the way he acts. I do not understand how I should be the only one accountable for the things he does why should'nt his father be accountable ? My 13 year old does not act that way but, he has nothing to do with her my husband has raised her.

If I were to get custody of him I know my marriage would be over it is so crazy when he is here, It makes me scared to leave the room if all my kids are together afraid of what he may do.

Is there nothing that can be done to get him back in school? Right now he has about a 4th grade education.

You both live in Indiana? And Indiana issued the child custody order? How about petitioning the court to order that he be enrolled in a regular school program, due to the failure of the father to properly administer a home school program?
