    Default Renting in Michigan with no written contract

    I have been living in my associate's house with him for almost a year in Michigan. He moved out in July. I have been watching his house and paying the utility bills only. We have no written contract. Can he legaly have me move out whenever he wants to? Or must he proceed with the Michigan eviction process only?

    If you're paying rent in the form of the utility bills, then you have a claim to a periodic tenancy, and thus to have your residency ended by the legal eviction process. Why does your associate wish to remove you from the home?

    Well, let me describe the associate to you. He has two felony convictions. He is very lazy. At times he admits he is absent minded. He tries to blame his problems on his A.D.D. I noticed how he breaks the law alot to make money.     He let me move in because I had some personal problems. At first he would tell me to pay half the utility bill when it was past due. After he moved out I been paying all the utility bill. He is presently living in a coin shop.

    Monday night this week when I got home I noticed two of his friends were in the back on the porch leaving the front and back door open. One of them was telling me he will be moving in with his family in December, so he will be fixing the place up. I ended our conversation by telling him to notify me 24 hours before entering again. I did not call the police to the scene because I did not want to get anything started. Besides, he could of told the police his friend was at the house to let him in and I was not truly a tenant. My associate's two friends left shortly.

    Late at night I did go to the police department expecting to make a trespassing report. A sergeant told me my associate could put me out whenever he wants because of no written contract. So the police did not write me a report for trespassing.

    Motives why he would like me living in his house:
    1. For protection of the people who are after him when he was living here.
    2. To watch and protect his house.
    3. To notify him of the ones delivering court papers while he is not living in the house presently.

    Motives why he would not like me living in his house:
    1. No high rent bills for me to pay, even though he pays morgage.
    2. Letting someone else move in who does pay high rent bills.

    A few times he did tell me he wanted me to start paying rent. I would tell him to sit down so we can talk about it. He tells me tomorrow we will. But next day he never does.
