Default Domestic Battery Assault Charges (minor present) in Florida
My husband drove 6 hours from Another State to Florida to visit his son. Got into and argument with the mother of his child, pushed her off defending himself, after SHE assaulted him twice.
To make the story short, a couple of hours after the incident he ended up being arrested in front of his child.
With the help of a lawyer in our state we found a lawyer in Florida, where the incident occurred.
We have so many unanswered questions, since we comunicate over the phone and briefly with this lawyer. He mentioned a waiver for the first court appearance / date, and that it would take about a month to get working on my husband's case.
Is my husband facing jail time, probation, a criminal record (he has never been arrested, or linked to any crime!)? What kind of things the lawyer should be working on? I don't even think that he has asked my husband about the incident! Should we get another lawyer?!?

Will greatly appreciate any advise.

If your husband is convicted he can normally expect to face, at a minimum, probation and a criminal record. His lawyer may be able to help him avoid a criminal record, as there may be a deferment option or diversion program available. If he is not satisfied with his lawyer, he should consider consulting other lawyers. Here are some suggestions for finding a criminal defense lawyer.
