    Angry Recovering Stolen Property from a Pawn Shop

    My question involves a consumer law issue in the State of: West Virginia

    The other day I went to pick up my guitar from a friends house. I kept it there because we played together on a regular basis. I was surprised to find that it wasn't there. After arguing back and forth, he finally told me the truth. He had sold it to a shop called pickers paradise(the equivalent of a pawn shop). I have the text from him that says he did steal it and sell it. Unfortunately the only proof I have that it is mine is a picture of it on my phone and the word of a other friend that sold it to me. The shop opens in 2 hours. And I am going to plead my case to the owner of the shop.

    When it was first found out that it was gone, I asked the friend who stole it (I was unaware at the time that he was the thief) to file a report. He wouldn't. I'm not keen on how the law works. So I'm not sure of the next step to take, but I don't really want to get the thief in trouble. Although he stole from me, I don't want to muck things up.
    Any advice is appreciated.

    You need to file a police report.

    Go to the pawn shop and explain the situation, buy your guitar back (so it does not get sold) and keep the receipt. Then sue your "friend" in Civil Court.

    By "equivalent of a pawn shop" do you mean it's an actual pawn shop, subject to the regulations imposed on pawn shops, or do you mean that it's in fact not a pawn shop and not subject to those regulations? Those regulations can make a big difference as to the legal duties of the shop.
