Default Workman's Compensation Question
My spouse gets a med. eval of her knee prosthesis every two years which the City is obliged to pay for along with any other related medical needs to this injury. The new contract Wh Comp carrier says she is two years and three days since her last eval & hence is over the Fl. statutory requirement. They threaten not to pay for evaluation and terminate all further medical. Please advise

WK Comp injury judgement gave my wife right for med review by physician every two years. Does two years and three days violate the terms of the fla statute?

Your wife's rights and remedies seem to turn on the language of the judgment you reference. I suggest you pose this inquiry to the lawyer who negotiated the terms of the judgment on your behalf. If you obtained the judgment without the help of a lawyer, I suggest you have the judgment reviewed by a lawyer in your state who practices workers' compensation law.
