    Default How to Get Rid of My Ex's Property

    My question involves a relationship in the state of: California

    My ex is currently in jail and I have a restraining order against him. He has a couch, a tv, and some car parts sitting in my garage. I've contacted my ex's family members about coming to pick up his stuff but I haven't heard anything back. Can I send a certified letter to his close relatives stating that if they do not retrieve his property within X amount of days, his property will come into my possession? Is that legal? If it is, how many days notice should I give them? And is "possession" the right word to use, or should I say I will dispose of his property at my discretion or something along those lines? Do I have to itemize all of his property in the letter? Sorry for all the questions, I'm a bit lost as to how to proceed!

    How long is he going to be in jail? If its going to be a relatively short amount of time I would not go the route you are considering.

    You can't steal his property merely because a third party won't collect it pursuant to your arbitrary demand.

    If he was living with you when he went to jail and it's that important for you to get his stuff out "right now", you can evict him through the courts.

    Ok then what can I do? He was never living with me. He never paid any of the bills and his name isn't on the lease. And I'm not trying to steal his property. I'm trying to get rid of it so I can cut all ties with this person. I'm not sure how long he will be in jail for, but I'm guessing it's going to be longer than 6 months, which is when I'm moving. So what can I do then to get rid of his stuff? Because I really don't want to be held accountable for it.
