HOA Snow Plowing

My question involves an HOA located in North Carolina.
For the past 10 years our homeowners association has provided year round access to our home by having the snow plowed in the winter. The road is private, long and steep and without plowing it is virtually unaccessible during snow events. This year due to the fact that only a few of us live there they are wanting to quit snow removal for the entire winter. Our Restrictions/Convenants require the road be maintained by the homeowners association of which we are a member of. If they do decide to stop snow removal do we as active members of the association have any recourse other having to pay for it ourselves. We need to travel the road year round to get to work and have emergency vehicle access. We could easily be injured trying to travel this road without snow removal. Thanks for the help.

You need to have somebody review the actual documents to determine what is meant by "maintained" and what remedies you might have in the event that the HOA does not fulfill its duties. We cannot guess at what those documents say, or how terms are defined. It is possible for a HOA to be responsible, for example, for physical maintenance of a road - patching, sealing, repaving, etc. - but not for plowing.

Understood. There is no real definition in the documents so it would be up for interpretation I guess. I thought maybe since they have provided it for so many years there was some kind of precedence set. I will never ever move anywhere where there are HOA's again. I have found that many of the people who like to get involved are power hungry and do it because they have little control in other aspects of their lives. I apologize if you are on an HOA board, not everyone who is on them are this way but mine is chocked full. Anyway thanks for your time it is always appreciated.
