I-797 Validity for Only 2.5 Months

Hi All,

My company has applied H1B for me last year i.e. 2011 and after getting RFE twice, my petition got approved on 17-Jul-2012 but on that petition the validity is from 17-Jul-2012 to 30-Sep-2012 (only for around 2.5 months). In my LCA the validity is upto 2014, and who ever applied with me has got the petition valid upto 30-sep-2012, Is this a clerical mistake ??? or Whom do I need to contact on this. Please suggest since the validity will expire soon.

It sounds like a clerical error, but it might not be. I suggest you contact the USCIS right away to find out what the correct date is. Their national hotline is 1-800-375-5283. Do you have any documented proof to established the 2014 date? You might need to show it as the workers there aren't necessarily the most diligent people in the world.

This is not an error, USCIS gave you approval based on your project/contract OR as requested by the Employer. LCA needs to be valid for days covering H1B Dates, you need to ask your employer to file an extension.
