In Texas, a retraction and/or removal of libel does mitigate damages.
it mitigates damages in most places but it does not undo what has been done.
I am not an attorney and any advice is not to be construed as legal advice. You might even want to ignore my advice. Actually, there are plenty of real attorneys that you might want to ignore as well.

If OP was using his fathers money to buy the coins for his father, can the coin company go after the father as the OP was representing the father like he was working for him?

What assets doe's the father have?

I don't see any legally cognizable connection between the allegedly defamatory statements and the father that would create liability on the part of the father.

So the OP only has $20,000 in assets (his father money). If OP gives that $20,000 back to his father, doe's it look like the OP is hiding $20,000?

Thank you for your input. I was almost tempted to talk to him again to let him know how broke indeed I am, but I will stay away from him. I agree, ultimately this will probably cost him more than me, but it'd be painful for them to attach my bank account when I basically live paycheck to paycheck.

Moving forward.... IGNORE HIM... do not respond to ANY communications, and do not personally respond to any communications by any attorneys, no matter how threatening they sound. Any attorney letters should be seen by another attorney before you respond at all.

If you are served with a summons, and that is a big IF, only then do you have to respond. If you do receive a summons or ugly attorney mails, then come back here for help.

In Texas, a retraction and/or removal of libel does mitigate damages.

It will also probably cost him more than he realizes to file a defamation suit, and his attorney should give him a reality check on that. Especially if they do not see you as having pockets deep enough to be worth suing.

My dad never told me to do any of the things I did. The only thing he wanted me to do was purchase these metals. Secondly, he asked me to take that money I got back, and buy him metals from a better company. I can't see how they can go after his possessions. I sure hope not anyway.
