    Default If a Minor Marries in Maryland is It Legal in Ohio

    My question involves juvenile law in the State of: Ohio
    My sons 16 year old girlfriend is pregnant and due in 5 weeks. Her mom and older sister have become very verbally abusive to her. She cries to the point of having braxton hicks contractions. Her mom has made the threat of keeping the baby and the girl in the house at all times so that none of her friends or my son and his family are able to see them. Her mom has made her start doing online schooling so that she is not even leaving the house for it. The girl and my son have talked about going to Maryland and getting married where it is legal. I do not wish for this but I want her and the baby in a safe loving home. If they do go to Maryland and getmarried it is under my understanding from what I have read on here that she would be considered emancipated, is this true and can there be any legal ramifications for my son?

    Getting married does not make the illegal suddenly legal. If the sex is/was illegal, then he could still face charges.

    If they are allowed to be legally married in Maryland (which I know from personal experience does not require residency), then the marriage will be recognized in all 50 states.

    As a parent myself, I will say this.

    They absolutely should NOT get married for this reason. It is probably one of the top three reasons why people should NOT get married.

    Your son's girlfriend's Mom has NO RIGHTS to the baby, and absolutely CANNOT keep the baby in the house; your son should establish paternity by DNA asap, and then he can file for some sort of custody/visitation and he will NOT be prevented from seeing his child.

    He is 19. The mom has consented to them and even had my son move in with them. He just moved out because of the verbal abuse. He asked for the girl to be able to come stay with us but the mom got very mad and that is when she started making the threats and pulled her out of school and will not let her leave unless one of her sister's are with her

    I married young so I know the struggles it will cause, my concern right now is for the care of the girl and the stress it is causing on her pregnancy. We all want a safe healthy delivery and baby

    In all honesty, if I were her Mom I'd likely also throw a fit and try to keep my child from the adult who impregnated her.

    But in the legal sense it does not appear that your son is in much danger of prosecution.
