Article 1, Paragraph 2 of the UN Convention Against Torture states the following: "This article is without prejudice to any international instrument or national legislation which does or may contain provisions of wider application." State of California Penal Codes 203-206.1 seem to have a wider application than many other instruments or legislation, so could California law be considered in a CAT complaint with regard to this article and paragraph even though it is not an international or national instrument?
