    Default Can You Restart a Homeowners Association

    Can a homeowners association "start over", or wipe the slate clean. We live in a community of 20 houses with an established homeowners association, but only one or two people have paid thier fees up to date, others are refusing because there is no records or payments for the last couple of years or expenses from the previous co-comitee.

    Is it possible to just wipe all the arrears and start over?

    if this was put to a vote, there is only 2 of the 20 houses tha would have a vote.

    To be clear, as sometimes people are lazy and post in the wrong forum - we are talking about a condominium community, right?

    Yes, well A homeowners association with shared property.

    The question isn't difficult. The body of law for COA's is different than for HOA's.

    You don't have to answer - but if you don't I suggest you consult a real estate lawyer with the relevant facts.

    Ok, Well I guess I just don't understand what you guys are asking, It says three times in this thread that it is a HOA as well as in the topic. I dont know what else you want but I just keep getting the same question of wether it is condos or not, I will just look else where for help.

    If you don't even know whether or not you live in a condominium community, your level of understanding of real estate is so rudimentary that we simply cannot help you. Go talk to a real estate lawyer.
