    Default Grandparents Allege Abuse and Are Seeking Custody

    My question involves a child custody case from the State of: Ohio

    Ok, this is going to be kinda long and you guys my have to ask questions to understand all of it.
    the other day my son went on a visit with his grand parents and they didn't bring him back but instead took him to the hospital. the doctors say that someone wiped him and we later found out that my baby's mothers boyfriend tapped his behind one time. social workers showed up and let my son go back with his grand parents till the investigation is over. me, my baby's mother and her boyfriend live in the same house and she has full custody of my son. the grandparents are fighting for visitations and custody of my son but the gal(guardian at lighum) said that they should be allowed to see him but once a month and they be supervised visits. I have told the social worker that i want my son and that i would move out and take my son with me instead of letting the grand parents take him because they cannot handle him in the first place he is adha and the grand father sleeps with a darth vader breathing aperatous and the grand mother cant walk.the mother has agreed to give me full custody legaly. so my questions are....
    1) do you think i will get him
    2) if a visitation order for the grand parents are in affect will it transfer to when i have custody
    3)what other things can i do to prevent the grand parents from keeping him


    im still thinking if i have more questions so i might ask more.

    also i should add that the custody was an agreement me and the mother had between me and he lawyer, and i didn't give up my rights. and lastly the grandparents have been calling child services for no reason and this is the 48th time all others have been proven no abuse. i have been proven to be the father

    One would infer, hard enough to leave significant bruising, resulting in the hospital visit, the doctors substantiating abuse, the immediate involvement of protective services, and their petitioning a court to remove the child from what they regard (and the court agreed) to be an abusive home.

    But you seem to have put yourself at a disadvantage by being part of the same household as the alleged abuser, and minimizing what protective services clearly sees as the abuse of your child.

    He has sleep apnea and treats it with a CPAP? If that's the best you have, you have nothing.

    That's nice, except you've suggested that the child is under the jurisdiction of protective services so it's no longer simply up to mom.

    That depends upon any number of factors, including whether you continue to minimize physical abuse and make excuses for the abuser, whether you can offer a safe, stable, appropriate environment for the child, your own background and issues (we know nothing about you).... As a general rule the preference is to keep kids with their parents, but we lack the information necessary to assess how protective services or a court would view you as a custodian.

    If there is a grandparental visitation order in effect, a modification of custody between you and mom would not of itself affect that order.

    Use some of that $million+ per year you make and hire a lawyer.

    im going to answer some of your questions. my background has some driving and no violent crimes, only driving and a theft from 12 years ago nothing else. the grandma is like 500 lbs and 5'2 has a Cain she walks with. and grandpa has breathing problems and also has a cane and with him being ADHD im 99% sure they cant handle him and if he was to run into the road the wouldn't be able to get to him in time for an example. i also have a voicemail which i have uploaded that my show that they dont watch him. the cps lady said she is going to ask that david be placed with me and I move to a different place that is cps approved.

    i also recorded the child services at the hospital and the follow up visit if you want to hear it to get a better understanding of whats going on.
