    Exclamation Old Police Report Falsely Describes Drug Arrests

    My question involves police conduct in the State of: I just received a report from 1996 where a police officer in maryland stated that he knew me because I had been arrested several times on drug charges. Problem is I have never been arrested what can I do what can be my recourse. this false report that he made was turned into child protective services and cost me lossing my child from my care.

    You are asked the state for a reason, laws vary. I can't believe a single report would have caused authorities to take your kids. Especially since you, or your attorney, could have proven the allegations were false by obtaining said arrest reports. I would imagine the child protective services, or whatever your unnamed state calls it, would have wanted to see the reports anyway.

    What is the nature of the “report” that this police officer made? Since you claim that you have never been arrested, it was apparently not an arrest report. Why did this “report” come to light now, 16 years later? How did this “report” come to the attention of CPS? What else did this “report” say about you and why did CPS give it so much weight? Why was CPS investigating you to begin with? What was the reason CPS gave for removing your children? CPS aint going to remove children from their mother because of a 16 year old drug arrest! Your post raises more questions than it does provide relevant information from which anyone here can provide answers.

    No that is not sticking to the exact question that I needed an answer to can a police officer file a false report stating that I had been arrested several times for drugs. IF I HAVE NEVER BEEN ARRESTED BEFORE ?!

    How is this relevant, sixteen years after the report was made?

    I guess you missed it with the first two responses to your post...WE NEED MORE INFORMATION TO PROVIDE AN INTELLIGENT ANSWER TO YOUR QUESTION! Just as an aside, posting in all caps is considered rude as it comes across as yelling. Since you are requesting assistance from total strangers who get nothing in return, coming across as rude probably isn't to your advantage.

    The simple answer to your question is of course an officer can write and file a report falsely claiming your were arrested! It's not that hard. He/she just has to take pen to paper, or press the little keys on the keyboard, write "Pam1$pam was arrested for drugs several times in 1996." Then all he/she has to do is "file" it...in a file cabinet, in a drawer, in a trashcan, in the CEO of ENRON's in-box, or wherever. You might note a slight hint of sarcasm in this answer...but, it is a truthful and complete answer to the question you just asked!

    So, in order to provide and intelligent answer your question, please tell us what kind of "report" this officer allegedly wrote and with whom did he/she "file" it? Did the officer write a crime report, regarding circumstances that occurred 16 years ago, and file it with a prosecutor??? Did he/she write a letter to CPS regarding your conduct 16 years ago??? Was it an affidavit regarding some legal action you are involved in filed with the court? Was it a letter to the editor in the local newspaper? Meet us half way here!
