    Default How Can I Get Out of My New Car Contract

    My question involves a consumer law issue in the State of: Hawaii
    I traded-in my old car for a new truck on sunday and had to bring it in on monday because I noticed the new car was swerving like I was drunk. They didn't get it fixed til friday. Even thought it's fixed I don't feel safe driving it with my kids in the car. I didn't even have the car for 11 hours. If I want my old cat back the dealership said I will be paying for two loans because they won't take the new car back.

    is this a brand new car or a new to you car? It really doesn't make much difference though either way.


    What was the problem with the car that it swerved about? Didn't it drive like that when you test drove it?

    It's a brand new car. The alignment needed to be fixed but the dealership had to wait for parts. I didn't test drive that truck,, I test drove another one but same style.

    You should have driven the actual vehicle you were purchasing but there is something wrong with your situation. A brand new vehicle should not have a problem and require any new parts. I would ask the dealer if that vehicle was involved in an accident and ask he give a written assurance of that.

    Unless you can show there was something such as the vehicle was damaged in an accident and that was not disclosed, it is unlikely you have any right to rescind the contract. You do have a warranty to deal with mechanical issues and that is about all they are required to provide.
