    Default House Surrender in Bankruptcy

    My question involves bankruptcy in the state of: Illinois

    Hello
    I recently had my 341 meeting where at the time had the intention of keeping my house. After thinking about my financial situation, I decided I want to surrender my home. Can I still do this or do I have to wait and to be foreclosed upon. I have no reaffirmed anything. Also am I still liable for HOA dues? And for how long?

    If you stop making the mortgage payments at some point the lender will foreclose. Not a big deal.

    YES you MUST pay the HOA (and maintain the property as required by the HOA) until the property is foreclosed or is otherwise out of your name (short sale for example).
