I do not believe you are prevented from making a claim against an at fault party if you do not have in insurance.
Is there a reason you are asking? Have they rejected your claim using that argument?

Well it just seems to be taking them a long time to investigate and give me compensation do for my vehicle that was totaled. I had no injuries at all just the loss of my van and they would not give me a rental car unless I payed for it first.
