Getting Sole Custody and No Visits from a Sex Offender Father

Hi! I have filed for sole custody of my 14 year old son and asking for a mod on visits with his father. His father (my ex husband) is in jail right now and will be getting out in less than a month. He is now a reg. sex offender for 2 counts of poss. of child pornography. He was only arrested last year on this last year and has no other crimes against him. There where no signs of this when I was married to him, we divorced over 10 years ago. My son doesn't want to see him right now. I was wondering how likely is it that I will be sole custody and either no visits or supervised visits (very limited in which my son gets to pick when he sees his father) I have lived in the same house for 13 years and have given my son a very stable house.

You have a very good chance of sole custody. The only problem I see here is the "which my son gets to pick when he sees his father" The child is a child, he does not get to make those decisions.

Before Dad's incarceration last year, how often did he see your son?

I had an attorney but after he took $3300 from me telling me he was filing for me he didn't do anything and I don't have any money left.

The reason why I said I would want it to be my son's choice is because he is starting high school in a few weeks. He is taking honors class, marching band and boy scouts. He doesn't have a whole lot of time where he could have his father around. Since as a sex offender his father wouldn't be allowed at schools or scouting trips.

He saw his father at least once a month for a weekend (fri at 7 to sun at 1). I have now been told by my son that his father told him to go into his room and watch tv and his father was on the computer the whole time. I do have papers from his trial stating the dates he was downloading the pornography and some of the time were weekends that my son was there

If anything, that might just guarantee that Dad gets visitation. Your son's extra curricular activities are secondary to his father's rights.
