My question involves guardianship in the State of: California
I found out yesterday that my father was arrested on the 24th of July, lets just say the family who knew aren't the most caring people in the world and didn't bother to tell me.
I'll cut to the chase; Dad is in jail for crimes supposedly committed towards step-mother, step-mother is unfit to take care of them and has threaten to take my half brother (7y.o) and half sister (5y.o) to Mexico in the past even though the were born and raised in the US.
By "unfit" I mean she is mentally abusive and, in the past, has been physically abusive. I believe she is un-diagnosis bi-polar. This woman is horrible, to say the least. I lived with them off and on during my teens and witnessed and endured much of what she is capable of.
My brother is the most stable of the two. Typical 7 year old boy.
My sister is the most concerning. She is prone to violent outburst and has imitated her mothers actions more often than not. Her mother and her grandmother (who live together) are very cruel to her. They will tease her or neglect her to the point where she will hit my brother, pull at her hair and bang her head against the wall.
Whenever I would raise questions about this behavior and confronted both parents things would get better. I was under the impression things were fine, obviously I was mistake.
So this leads me to my questions:
1. I am 21 years old in October. I work part time and I'll be going back to school soon. I know the chances of me being able to get even a temporary guardianship may be slim.
But just how slim are they?
2. I have a 24 year old sister who is married. Her husband is in the Air Force and are currently stationed in New Mexico What is the likelihood of them being able to get any type of guardianship?
Both my older sister and I are willing to do any and everything to keep them from foster homes and family members that aren't us. Basically, we are the only ones who care. The draw back to my sister is that the kids don't know her super well because she has lived far away for a few years. They are, however, super comfortable with me. My draw back is that I would not be able to financially take care of them for a long period of time without some sort of help.
Please, any information you can give would be great and fill free to inquire for more information. My mind is running on little sleep and full speed.
