    Default Is Income Earned in Seperation Seperate

    My question involves a marriage in the state of: CA

    We seperated 6 weeks ago. We have not signed a seperation agreement just yet, maybe a few weeks.

    I just made a big sale at our business for $5,000.

    Can I keep these funds seperate?

    Or should I delay the sale until after the seperation agreement is signed?

    The safest route would be to delay the sale until after the separation document is signed. Even though at this stage the funds from your sale are technically considered separate property since you guys already separate 6 weeks ago, the problem is proving when the official date of your separation began. The date on your separation agreement is the strongest evidence that establishes your official separation date. So delay the sale if you can, or make sure the date on the separation agreement that you both sign reflects the earlier date.
