    Default Child Care Costs if Custodial Parent is Not Using Child Care

    My question involves child support in the State of: Florida

    I there. We have had a support order inforced since 1/2011. A little over $160/month was specifically in the order to go to childcare afterschool costs for this child. We have heard this child has not been in afterschool care the past 20 months. What happens in these sort of situations?? This is roughly $3200 that was supposed to go (and ADDED to the child support order!) towards childcare over the past 20 months. Seems very unfair, she lives at home with her mommy while we are trying to support a child of our own.

    If you believe you have a basis to modify the order, bring a motion. Note that "We have heard" doesn't necessarily mean that the child is not in care, and that sometimes bringing the motion will inspire the parent to again put the child in aftercare.

    I very much doubt that you are ordered to pay anything, OP.

    This child IS your husband's child. Does the child need to eat less simply because Dad had another child?

    Ummm, yes, we ARE ordered to pay the $160. And when I say we I obviously mean my husband, but we are a unit so same thing! We are not involved w/ this kid AT ALL and want to pay the bare legal minimum to keep my husband out of jail. In fact, I'm counting the days til he turns 18.

    Dogma-in case I wasn't clear enough in my above post, the custodial parent lives at home w/ her mom. BTW - the $160 I was referring to has NOTHING to do "with the child eating" that was the amount added to the original support order for child care costs ONLY! He pays waayyy more than 160$/ month in child support!

    That's one of the most cold-hearted posts I've read in awhile.

    Hopefully Mom will get wise and go for an upwards modification.

    Something isn't adding up here. The order was enforced or created 1/2011? In order to get the order created the mother should have provided the court documentation of the child care costs. So saying that the child hasn't been in child care for 20 months isn't adding up.

    If the husband can provide proof to the court he can file a motion to modify the order. He would need to be prepared to provide the court complete current financial information. If his income increased there is a chance his support payment would not change in his favor.

    This is really your husband's issue to work.

    Wow. Just cold. That child is your husband's child, and half sibling of the one you have together. You're not talking about a gerbil or a parakeet.

    Dogma- he was only with her for a few months and she lied and got pregnant. He wanted to abort that child. They broke up before it was ever born. I wish she would have had am abortion EVERYDAY, believe me. We really could use the extra money. He has NEVER met this illegitimate child either. We are married and have a son together who he loves more than anything. THAT is his son, not that other kid.


    As far as the order, it was in the court at the end of 2010. Started coming out of his check in January 2011. She got knocked up w/ another bastard kid that month and never went back to work, hence no daycare.
