Who Qualifies for the Petit Offense Exception

Court Action: PLED GUILTY & SENTENCE IMPOSED PG 155.25 CONDITIONAL DISCHARGE=1 YEAR

State: New York

I'm a foreigner and live in India and I'm going to visit Miami. Can it be a problem while entering the US? Do you think I qualify for petit offense exception?

The petty offense exception applies to a person who can show that she: (1) only committed one crime and that the crime in question is her first offense, (2) the maximum penalty for the offense does not exceed one year, and (3) the person was not sentenced to more than 6 months imprisonment.
