    Default New Charge Filed After a Plea Bargain for the Same Events

    My question involves criminal law for the state of: Michigan

    Our daughter, age 17 received an MIP and a possession of tobacco (which was dropped down to faulty equipment) in July 2011. She completed probation and was released. However, she was recently (July 2012) pulled over for speeding and the officer stated that there was a warrant for her arrest for a July 2011 "transport open intox". She paid a $100 bond and was given a court date.

    No one is able to give us any details until she is arraigned. The clerk would only tell us it stemmed from the July 2011 MIP and she was charged by the prosecutor September 2011 and a warrant issued October 2011.

    How can this happen?

    Are we talking about a charge in the same court, authorized by the same prosecutor? If not, please elaborate.
