My question involves a child custody case from the State of: California (San Diego area)
My 6 year old's father & I never married. I would like to file for sole legal custody of my daughter. She really has no relationship with her dad - he'll call once in a blue moon (a few times a year) but he hasn't even seen her in almost 3 years nor does he pay court-ordered child support ($79/mo). He also has quite a record from drug convictions, domestic assault/battery, and even an injury to child (his son from a previous relationship). From my understanding he just moved back to CA (Northern) from Idaho. He hasn't held a job for any period of time for as long as I have known him, regularly smokes weed, has 2 other children (17 & 12) they have gone through the same thing (no child support, no relationship). I've worked at the same school district for 10 years, drug free, and have been 100% financially, physically and emotionally dedicated to my daughter & her well being.
Had any of this come to light before my daughter was born I would have run for the hills!
I don't want to open a can of worms if I don't feel pretty positive that I will be granted the custody, is there a good chance I could come away with the sole legal/physical custody I want?
