    Default Family Members Packing Up Property Without Executor Present

    My question involves estate proceedings in the state of: Minnesota.

    My grandmother just passed away this past week. My dad executor of the will has been nice enough to let my Aunt and her daughter stay at the residence instead of at a hotel. In the past day she has went through everything and began packing things up that she wanted along with other things. I am researching for my father trying to figure out which laws she may or may not have been violating. I know there is some because she was not giving permission to do any of this and has been informed to stop.

    There was also money in the house there is possibility that was found and was basically pocketed without words being said to the executor as well. Working on proof on that but if its true what can be done about that?

    as to the aunt packing up anything and taking anything; she has no right to do so unless it is her property. If she takes things belonging to the estate, it is theft.

    the huge question: can you prove it? If not, there is nothing you can do.

    if he doesn't want to get anybody to get arrested, he can ask the probate court to issue an order that she return all property taken from the estate. He could also report the theft to the police but that could end up with some serious repercussions to the aunt that may not be what dad wants to happen.
