    Default Working With No Pay

    I work for a company as a contracted employee. I make $10 a sale when my customers are medicare, and $6 a sale when they are with a accepted private insurance. I make nothing hourly nor salary, so if I sit here all day and do not make a sale, I was just at work all day for free. The past two weeks my company has not issued any leads, other than some disconnected numbers, or some that are not even diabetic. What we do, we sale medical supplies, but only if patients are covered threw medicare. At the current moment I am not making anymoney, and have been informed that I signed a contract saying that I can not go work for any other call centers for the next two years. My quota is 35 items a week, and am lucky if I am getting 100 leads. I can be terminated when ever the employeer chooses for not making the quota, I don't know a whole lot more, other than I have never worked for another job that didn't pay salary or hourly. Is this legal?

    Which part are you asking about the legality of? Are you asking if it's legal for a company to pay you on commission only, if it's legal for them to set a quota and fire you for not meeting it, or if it's legal for them to prevent you from working for another call center for the next two years?

    You refused to identify your state. It does make a difference.

    You posted in the category for independent contractors. Are you an employee or are you an independent contractor? If you are classified as an independent contractor (annual 1099, no taxes withheld from pay, etc.) and you believe you should be classified as an employee, read this.
