    Default Window Tint Warning

    My question involves vehicle maintenance laws for the State of: Michigan

    Yesterday I was pulled over by a state trooper. He then stated that the tinting on my car was illegal, not compliant to MI law MCL 257.709:

    so I handed him my papers. He came back and gave me a verbal warning for the tint but said there is now a note in there system that my car has been pulled over for having illegal tinting. Is there anyway I can have it removed? Will another officer see this if I get pulled over again and cite me for it?

    Have what removed? The tint? Sure - most of the shops that install tint will also remove it, or you can peel it off yourself and use a product like Goof-Off to remove the glue.

    If you have an unlawful window tint, you have an unlawful window tint. I expect that would be a fix-it ticket, but an officer can ticket you for your unlawful tint job whether or not you've been previously warned. There is absolutely no reason the police should, or would be compelled to, remove a warning - a break the office gave you instead of a ticket - from their system.

    Without knowing what method the department uses to reference warnings and whether other local agencies can access those warnings, I cannot say. However, in 2012, it is quite likely that any officer in the area that stops you in the future will see that you have been previously warned. Will that officer then decide to cite you if the violation still exists? Well, only that officer can say...but, I would put my money on you getting a citation.

    I know in NJ if a trooper were to issue you a warning, only other troopers could see that warning, city, county of sheriff's can't see the warning. The warning would fall off file in 9 months.
    I'm not a lawyer, but I did stay at a Holiday Inn Express last night.......
