    Default Can Support Be Ordered Before Paternity is Established

    My question involves paternity law for the State of: CT or PA

    My husband was recently contacted via FB by a young woman who says he is listed as her father on her birth certificate. He does remember a one-night stand with a woman that would result in a child that matches her stated age (23). She provides information on the mothers name, but no details of the timeframe that she was conceived or where she was born. Through some basic research, we can deduce she was born in either PA or CT. My questions...
    Is it possible for a mother to list a fathers name without his consent in either of these states? Can the mother file for child support with no acknowledgement from my husband that he is the father and/or without his signing the birth certificate or otherwise "proof" of paternity?
    Now that she is 23, is he obligated to pay back child support and/or how can he determine if he owes back child support?
    He wants to contact this young woman and determine if she is his daughter, but first wants to understand better what he may be facing when he does so.

    If Mom filed for child support, Dad could well be obligated. Unless someone is sure of what was needed to establish paternity in these two states 20+ years ago, I'm not sure we can say with any confidence that he's not on the hook.

    My hunch is though that an AOP/DOP was not needed, since that was the case for the vast majority of states until fairly recently - in other words, Mom could well have listed him on the birth certificate without his knowledge.

    The CT statute was passed in 1981. The PA statute was passed in 1985 and became effective in 1986. The child is now 23 years old. I think mom would have a hard time bringing an action for support now, which seems to be the OP's fear. He was listed without his knowledge and has has no contact ever. oP and her husband could call family law lawyers in those states for a free consult and I'm fairly confident that the answer will be no, it is too late under the statue to bring an action for support. Dad should have been afforded the opportunity to dispute paternity years ago. Due process and all...
