    Default Bankruptcy Malpractice

    My question involves legal l malpractice in the state of: Texas

    My grandmother filed Chapter 13 bankruptcy in 2009. She had one debt that she is to pay off - her car so that she can keep it. Everything else was to be discharged. The trustee has been paying all of her UNSECURED debts instead of her car!!! The lawyer never caught this and we just discovered it. Isn't that malpractice???

    Has her lawyer told her that an error occurred, or has her lawyer told her that she misunderstood the bankruptcy plan. If she excluded the vehicle debt from the bankruptcy, payments would be made by her while her repayment plan would apply to her other debts.
