    Default Opposing Counsel Has Conflict of Interest, Do I Have a Right to Know What That is

    My question involves court procedures for the state of: TN

    Hello all. So I am in a civil matter against my Mother in the Juvenile court of TN. She has an attorney and I do not. My mother had an attorney and we had talked on a weekly basis to try to come to some kind of agreement. Today I get an email from her attorney stating: " Unfortunately, I have discovered conflict a conflict with my representation of my mom and she has employed a new attorney. We will be entering an agreed order of substitution of counsel and I will no longer represent her". They then gave me the new attorney on record. Do I have a right as an involved party to know what exactly that conflict of interest is?

    If the conflict of interest involved you, the lawyer would have a relationship of some sort with you and would presumably be explaining the nature of the conflict to you. It does not appear that the conflict in any way relates to you, and it appears to be the result of a relationship unrelated to your case, so you've given us no reason to believe that either your mother or her former lawyer owe you any explanation.

    It's possibly not even the lawyer who has an involvement of some kind. It could be any member of his law firm. If any member of his law firm has ever represented someone in a case your mom or any other party of interest was in any way involved in (unless they were representing her) the lawyer may have to "conflict out."

    Rather than owing you an explanation more than you got, the reason may actually be confidential. You aren't harmed. Your mom simply has a new attorney and you've been given notice.
