    Default Is a Texas Speeding Ticket a Misdemeanor

    My question involves a traffic ticket from the state of: Texas



    Several years ago I recieved a speeding ticket in Texas (I'm an out of state driver in PA). Other then the fact that I was speeding, it was a pretty routine ticket, no DUI, reckless driving, etc. I was given a citation for speeding and drove the rest of the way home to PA. Several days later I mailed in the fine (around $200) as it obviously would have cost much more to fly to Texas, hire a lawyer, etc.

    I am now applying for a job and I am curious as to how this ticket is classified and if I should answer "yes" to have you ever been convicted of a Misdemeanor? If you look on the court records for any charged with a speeding ticket (I can't find my record) it lists this ticket as a Traffic Infraction as oppossed to "Adult Misdemenor" as you would find on someone with a DUI. However when you click on each record, under category it stats "Traffic Misdemeanor" as oppossed to "Adult Misdemeanor"



    Can someone who is much better at Law then me, interupt this for me? Is there a distinction b/w "Traffic Misdemeanor". When I google Texas traffic lawyers, none of them mention a misdemeanor charge for speeding (you think they would) so I really don't know. Any help you could provide would be much appreciated.

    Most traffic offenses in Texas are Class C misdemeanors, which are technically criminal offenses but carry a penalty of only a fine. So it would appear your answer is "yes" - but I expect that they're interested in more serious charges such as DWLS, DUI, reckless driving and the like.

    I have no access to your court record or the code section of the charge to which you entered the guilty plea; but all Texas speed law offenses are misdemeanors.

    (a) A person commits an offense if the person performs an act prohibited or fails to perform an act required by this subtitle.

    (b) Except as otherwise provided, an offense under this subtitle is a misdemeanor.
