Default Husband is not the father
I was sent to Korea in April, I found out June 4th that I was pregnant, and though I am married, by conception date adds up to it not being my husband... Not a big deal, I really do not want my husband in my life and upon return to the States am filing for divorce, which he has already agreed to sign uncontested, ending the divorce hopefully, quickly. The father of the child, is going to be living in Savannah, Georgia and we have decided for the sake of our child that I should live with him. The issue is, I do not want my husbands name on the birth certificate, nor do I want the child to have his last name... My husband is fully aware of the situation, and so is the father(as I've stated) so now I'm just... confused and lost, I suppose...

Are you in the military? If you are, you may have bigger problems.
In what state does your husband reside? Is that you state of residence? Where will the child be born? Some states allow for the biodad of a married woman to sign an acknowledgement of paternity, others do not. If you want to be divorced and you both consent, why not get divorced now?

I am former military, and I understand the stipulations of that, however... do not assume that my husband who is also military, hasn't stepped his boundaries either... Regardless, I am from Kentucky, where luckily for me, the paternity waiver seems to reign supreme... The only major issue is, that my husband will be overseas when the baby comes, and I was under the impression he had to also be present to sign such documents. And as far as doing the divorce now, I have tried unsuccessfully to find a lawyer as the time difference makes it very difficult to contact people during their working hours, which involves me being up until very late in the evening, and physically I cannot handle that on top of the 12 hour days I work already... If I had help I may have been able to do it by now, but my legal office here is in no way willing to help and just told me to seek a civilian lawyer....

If you have your baby in KY then bio dad can sign the AOP, one of the few states where a married woman can have the bio dad/not the husband sign the AOP. How soon before you will be stateside? There are online divorce kits for Kentucky and you might want to contact attorney's in towns located near military bases and I'll bet you can do your communication by email. Expect your husband to envoke the SSCRA if the two of you cannot come to an agreement.
