Fishy HOA Payments

My question involves a condominium located in the State of: California

I recently learned that hor HOA treasurer has been paying HOA gardening fees from his personal account and then not paying his monthly HOA dues for severeal years. As a result, he says he doesn't owe HOA dues. Seems really fishy expecially as he hasn't produced canceled checks from his account. Is there any point of law I can use to force him to pay dues or get a judgement against him?

Are you on the HOA board??

Unless you are, and the CC&R's say otherwise, it's something the HOA board would have to take up, and it's up to them to take action if there are improprieties involved. You personally have NO STANDING to force him to pay anything.

Now, another route is for you to pass petitions around and have condo owners take action if the HOA doesn't. I was a condo owner, and we had HOA decisions overturned via the petition route.
