My question involves criminal law for the state of: California
In December of 2011 I was charged with a DWI, and a felony weapon possession by an over-zealous sheriff. I spent 4 days in county jail and was released on a "No Action" on my charges. At the end of April I received a letter telling me I was being charged with A misdemeanor DUI, and a misdemeanor weapons charge. I had my day in court, and my Public Defender got them to drop the weapons charge if I plead guilty to the DUI, which I did.
Now, when I was being sentenced, I was issued a $2000 dollar fine, and 10 days of community service(Work Project). Since I spent 4 days in county jail, they told me I had 8 days of credit which could be applied to my fine or to the Work Project. $800 off of my fine, or 8 days off of the Work Project. I chose the fine because I was unemployed and had time to spare for the Work Project. Now a few months later, I have a job offer, but I can't take it until my Work Project is done. I've been told the job may be gone before my Work Project schedule is done.
I can expedite the Work Project by going on standby everyday, but even then, the job may already be taken by another candidate.
So my question, is it possible to change where my days credited go? Can I switch my $800.00 off of my fine to 8 days off of Work Project? It would enable me to get a job this week and pay the fine off much faster than the $75.00 a month that I am right now.
