My question involves a traffic ticket from the state of: Michigan
I recently recieved an Impeding traffic ticket. My initial accused violation was for turning on a red signal with a "No Turn on Red" sign posted on the side of the road. The officer told me he was doing me a favor for writing me up for the impeding traffic instead of the No turn on Red ticket becasue it was NO points but the fine is $175!!
I was told by a retired officer that the sign is not legally binding unless hung up by the traffic signal. Since this sign was down on the side of the road on a post in the ground do I have any legal standing to fight this ticket in court? Please read the the following paragraph from the Michigan Vehicle Code:
"(5) A sign prohibiting a turn on a red signal as provided in subsection (1)(c)(ii) shall be located above or adjacent to the traffic control signal or as close as possible to the point where the turn is made, or at both locations, so that 1 or more of the signs are visible to a vehicle operator intending to turn, at the point where the turn is made. An additional sign may be used at the far side of the intersection in the direct line of vision of the turning vehicle operator."
Is there a place where I can look up past court cases to see if this has ever benn fought and won?
