    Default No Turn on Red Sign Location

    My question involves a traffic ticket from the state of: Michigan

    I recently recieved an Impeding traffic ticket. My initial accused violation was for turning on a red signal with a "No Turn on Red" sign posted on the side of the road. The officer told me he was doing me a favor for writing me up for the impeding traffic instead of the No turn on Red ticket becasue it was NO points but the fine is $175!!

    I was told by a retired officer that the sign is not legally binding unless hung up by the traffic signal. Since this sign was down on the side of the road on a post in the ground do I have any legal standing to fight this ticket in court? Please read the the following paragraph from the Michigan Vehicle Code:

    "(5) A sign prohibiting a turn on a red signal as provided in subsection (1)(c)(ii) shall be located above or adjacent to the traffic control signal or as close as possible to the point where the turn is made, or at both locations, so that 1 or more of the signs are visible to a vehicle operator intending to turn, at the point where the turn is made. An additional sign may be used at the far side of the intersection in the direct line of vision of the turning vehicle operator."

    Is there a place where I can look up past court cases to see if this has ever benn fought and won?

    I don't see how anyone would limit that description to "it has to be hung up by the traffic signal" or how it being on a post near the turn and/or signal would invalidate the citation.

    So how difficult was it in this cae to determine that the sign in question was referring to that particular turn? Anyway you can post a Google Street Map link to the intersection? If you choose to do so, please indicate your direction of travel and the specific location of the particular sign in question.

    I don't know of ANY state that documents all traffic trials and even if one did, I would doubt it would be practical to provide access to trsnscripts. You would have to hope someone had appealed on that basis, and even then, that the decision was deemed precedent setting that a decision to publish it was made. You could start searching at Google Scholar
    I am right 97% of the time... Who cares about the other 4%!

    Since you were cited for impeding traffic, and NOT illegal turn on red, anything about the signage is completely irrelevant to your case. Post the officer’s statement so we can see how he articulates how you impeded traffic. That is the only thing that is relevant to what you were actually charged with.
