    Exclamation Missing the Final Probation Meeting After Paying All Fines and Assessments

    My question involves criminal law for the state of: UTAH
    My fiancé paid off all his fines & probation cost, along with taking and completing all required classes for his probation, and he actually paid all of this including probation costs early... (this is his first time being on probation). He also never missed his once a month appointments w/ his probation officer but one time. He was placed on probation for a first time 3rd degree felony (the only felony he has) for failure to respond at the command of a police officer. But he did miss the last appointment with his probation officer (not intentionally) and the probation officer never contacted him until three months later knowing where my fiancé was employed, knowing his phone number, and knowing where he lived, and his probation officer came to his residence the three months after the appointment and issued a warrant which lead to his arrest not even a week after. Any ideas on what may happen to my fiancé when he goes to court.?

    Of course, the flip side to this is that your fiancé never contacted his PO for three months after he KNEW his missed an appointment...even knowing where his PO was employed, knowing his /her phone number, etc. etc. etc. A PO is not a babysitter. it was your fiancé's responsibility to contact the PO, not the other way around!

    Correct. Your fiancé failed to comply with the terms of his probation. Probation violations result in warrants and arrest. What did you or your fiancé expect would happen after he decided to just blow off the conditions of his probation?

    What MAY happen is that everything your fiancé did during his probation (costs, classes, time, etc.) gets flushed down the toilet and counts for squat. The full sentence for your fiancé's offense is re-imposed and he gets that fine along with jail time. That is worst case, but it IS possible.

    What is likely to happen (depending on his prior criminal record and how much he has pissed off the judge that gave him the break of probation that your fiancé pissed on) is that your fiancé's probation is extended...likely with some new, more strict conditions.

    By saying that he missed his final probation meeting, you are implying that he the very last appointment that he would have prior to terming from papers. I kind of find that doubtful as the PO violated three months after that failed appointment to snatch him up. It was three months. I know if I had such a good run and I unintentioanally missed an appointment, I blowing my PO's phone up tryingto get back in. Hell, my guys show up unscheduled and wait for hours just to make sure I don't send tham back.

    I get the feeling at his hearing, there will be more than just a failed appointment that'll be discussed. Everything that PTPD said is right. It could all be for nothing. More than likely, he'll get reamed out by the judge and recommitted to terms of probation all over again. But, if that happens, he has no room for error again.
